Reference D.lgs.n.116 03/09/21
With the entry into force of D.lgs. 116/2020, this notice has been prepared to support our customers by describing the measures Sivit has taken to comply with the regulations. D.lgs. 116/2020 introduced significant updates to the Environmental Code 152/06, including the mandatory labeling of packaging within its scope. This is to facilitate the collection, reuse, recovery, and recycling of packaging and to provide consumers with correct information about the final destinations of packaging. Decision 129/97/EC, which mandates the application of material identification codes on all packaging (primary, secondary, tertiary), remains in effect.
Note: These provisions are valid exclusively in Italy; each EU member state has regulated the matter similarly, but the specific requirements must be verified case by case.
Identification Codes
Sivit's packaging suppliers have assigned identification codes in accordance with Decision 129/97/EC, and these codes are displayed on the packaging itself.
Packaging Destination Circuits and Collection Instructions on Labels
The destination circuits for the packaging used by Sivit and the related activities carried out in compliance with the aforementioned decree are as follows:
Industrial Sector (B2B) - Sales to Professionals
Disposal must be carried out by authorized companies; it is not necessary to include collection instructions on the label since all packaging in this case is considered special waste, hazardous or not. However, if there are secondary packaging materials (e.g., boxes or stretch films) or packaging components that are not contaminated with hazardous substances (e.g., seals and staples, joining rings, caps, ties, etc.), refer to the identification labeling on these items. If absent, detailed information must be provided.
Domestic Sector (B2C) - Sales to Private Individuals
Disposal should be carried out by the user in accordance with the guidelines of their local municipality. For hazardous products, the label includes the phrase “P501 Dispose of contents/container in accordance with local regulations”*, while ensuring the identification code is also present on the packaging. This approach is detailed on the official website www.etichetta-conai.com.
- This phrase is already mandatory for sales in large retail in reference to Reg.CLP 1272/2008.
If there are secondary packaging materials (e.g., boxes or stretch films) or packaging components that are not contaminated with hazardous substances (e.g., seals and staples, joining rings, caps, ties, etc.), the nature of these materials must be specified on the label along with disposal instructions. This information is provided by the packaging suppliers and must be communicated to the relevant parties.
